No Relief For Arvind Kejriwal In Liquor Policy Case, SC To Hear Matter On June 26

The Supreme Court on Monday refused to pass an order on a plea by Delhi chief minister Arvind Kejriwal challenging the Delhi High Court order which stayed the bail granted by lower court to Kejriwal in the liquor policy case.

The Supreme Court has now begun it’s hearing on Arvind Kejriwal’s bail plea in connection to the liquor policy case.

A vacation bench comprising Justices Manoj Misra and SVN Bhatti is hearing the matter. “If we pass an order, we will be pre-judging the issue. It is the High Court and not a subordinate court,” the top court bench was quoted as saying by Bar and Bench.

Kejriwal’s advocate refers to SC observation keeping legality of arrest under consideration:

Senior advocate Chaudhari representing Arvind Kejriwal referred to the SC observation in May 10 order that legality of arrest is under consideration and that a liberal view has to be taken regarding interim bail.

He also referred to the May 17 order of SC reserving judgment on Kejriwal’s challenge to arrest, highlighting that in that order, SC had allowed him liberty to apply for bail.

If we pass an Order now, We will be prejudging the issue, Says SC:

While hearing the matter on Arvind Kejriwal’s bail plea at the apex court, the bench said, “If we pass an order now, we will be prejudging the issue.”

The Supreme Court adjourned Arvind Kejriwal’s petition and said that it will hear the matter day after tomorrow.

The apex court also said that if the HC’s order is passed in the meantime, then it can be brought on record.

Delhi Chief Minister Arvind Kejriwal did not get any relief from the money laundering case linked to liquor policy scam as the Supreme Court said that it will hear the matter next on June 26. The apex court further said that it will wait for the High Court’s order on the stay application.

Arvind Kejriwal moved to the Supreme Court on Sunday challenging his bail order that was granted an interim stay by the Delhi High Court on Friday.

The bail order was earlier granted by the trial court in the money laundering case pertaining to the liquor policy scam.

On Thursday, Delhi’s Rouse Avenue court had granted bail to Arvind Kejriwal on a bail bond of Rs 1 Lakh, which was to be furnished before the duty judge the next day.

The stay order came after the ED sought a stay on the order and asked the court to give 48 hours to sign the bail bond so that the order could be challenged in the higher court.

The Delhi HC had also issued notice to Kejriwal seeking his response to the Enforcement Directorate’s plea challenging the trial court’s June 20 order by which he was granted bail. The court had further said it was reserving the order for 2-3 days to review the entire record.
